Terms & Conditions
Please read our Terms & Conditions (the “Terms”) carefully. These Terms are a contract between Humble Haven Yoga (“HHY”) and you. When you sign up for a membership, book a class, workshop, or retreat, or access our website or on-demand videos (the “Services”), you agree to accept these Terms and to be legally bound by them. HHY reserves the right to change these Terms at any time without providing you with advance notice. Your continued use of the Services constitutes your acceptance of the changed Terms.
1. Disclaimer & Liability Release. You acknowledge that the Services involve physical exertion which may be strenuous. It is your sole responsibility to consult with a physician before participating in the Services. As a condition of being permitted to engage in the Services, you assume the risk and hazards involved, including physical injury. You knowingly, voluntarily and expressly waive and disclaim any claim you have or may have in the future against HHY, its instructors, contractors, employees, and any other HHY agents for: (i) loss, theft, or damage of any personal property from HHY premises; and (ii) injuries or damages that you may sustain within the HHY facility or as a result of participating in the classes, programs, workshops, and events administered by HHY. You forever release, waive, discharge, and covenant not to sue HHY for any injury or death caused by negligence or other acts that are not intended to harm you. Review full liability release below.
2. No Refunds. All class package, annual unlimited, and single class purchases are final sale and non-refundable. Tuitions for yoga teacher training programs and retreats are non-refundable once the training or retreat has begun. Deposits for training programs and retreats are non-refundable once paid.
3. Membership Contract Period. All memberships begin with an initial three (3) month term. After the initial term, memberships automatically renew for one (1) month periods until cancelled. You may cancel your membership with one (1) billing cycle advance notice by emailing info@humblehavenyoga.com or directly in the app. Annual memberships can not be cancelled or transferred.
4. Freezing Membership. You may freeze your monthly membership account once per calendar year for a maximum of sixty (60) days. Annual memberships can not be paused or extended.
5. Cancellation Policy. You may cancel a group class reservation without penalty up until 2 hours before class start time. You may cancel via our online scheduling system which is accessible through our branded app or by logging in through our website. If you do not cancel 2 hours prior to class then: (i) if you have a membership or class package, you will lose a class credit and incur a $10.00 late fee; and (ii) if you are a drop-in client, then you will lose your single pass and will not incur a late fee. If you do not show up for class and do not cancel, you will incur a $15 no show fee. Workshops must be cancelled up to 48 hours prior their start. Refunds for workshops are not automated and must be requested by reaching out to info@humblehavenyoga.com. If your workshop registration is cancelled within 48 hours you lose the pass and no refund is granted. Private Yoga appointments must be cancelled with 24 or more hours notice in order to reschedule or be refunded. Payment for private yoga appointments is required prior to their booking.
6. No Late Admission. For the safety of our students and because we do not always have additional employees outside of the teacher working, HHY does not allow late admission once a class has begun.
7. Intellectual Property Rights. This website is protected by copyright, trademark, and other intellectual property rights. All content on this website, including on-demand videos, is the property of HHY and may not be distributed, adapted, or used to create derivative works without express written permission.
8. Indemnification. You agree to indemnify and hold harmless HHY and its affiliates, employees, officers, and agents from any claim made by a third party connected with or arising out of your use of the Services.
9. Governing Law. These Terms and any claims arising out of or connected to the Services are governed by the laws of the Commonwealth of Virginia. You agree to submit to the exclusive jurisdiction of the state and federal courts located within the geographic boundaries of Richmond, Virginia.
10. Entire Agreement. These Terms and any linked notices, policies, or guidelines contained on this website constitute the entire agreement between you and HHY. The Terms supersede any prior understandings, agreements, and representations between the parties regarding their subject matter.
11. Your Data. HHY may collect information from you when you register on our site, subscribe to our content, or fill out a form. Any of the information we collect from you may be used in one of the following ways: to personalize your experience, to improve our website or customer service, and to send you periodic emails. We may use the email address you provide to send you information, respond to inquiries, and/or other requests or questions. We do not sell, trade, or otherwise transfer to outside parties your personally identifiable information. Non-personally identifiable visitor information may be provided to other parties for marketing, advertising, or other uses. By using our Services, you consent to this data privacy policy.
Release, Waiver of Liability, Assumption of Risk & Indemnification Agreement
1. Voluntary Participation
I understand that participation in yoga classes, hot yoga classes, workshops, trainings, retreats, online instruction, and related activities (“Activities”) offered by Humble Haven Yoga is voluntary. I certify that I am physically and mentally capable of participating.
2. Assumption of Risk — Hot Yoga & Physical Activity
I understand that yoga, including hot yoga practiced in a heated environment where temperatures may exceed 95 degrees, involves inherent risks, including but not limited to:
- Elevated heat and humidity
- Dehydration, dizziness, fainting, heat exhaustion, or heat‑related illness
- Muscle strain, sprain, or injury
- Joint stress or aggravation of pre‑existing conditions
- Slips or falls due to sweat or humidity
- Risks associated with props, equipment, and hands‑on assists
- Exposure to communicable diseases
- Personal property loss or damage
I voluntarily assume all risks, known and unknown, associated with participation in these Activities.
3. Airborne Illness & Infectious Disease Exposure
I understand that participation may involve exposure to airborne illnesses, including but not limited to COVID‑19, influenza, respiratory viruses, and other communicable or infectious diseases. I voluntarily assume all risks associated with such exposure.
4. Yoga Is Not a Substitute for Medical Care
I understand that yoga is not a substitute for medical examinations, diagnosis, or treatment. Yoga instructors are not licensed medical professionals. I acknowledge that yoga practice and/or specific poses may not be recommended for individuals with certain medical conditions, including but not limited to cardiac illness, later stages of pregnancy, recent surgery, or acute injuries.
5. Physician Consultation
I understand that it is my responsibility to consult with a physician before participating in any Activities, especially if I have pre‑existing medical conditions or concerns. I represent that I have either consulted a physician or voluntarily chosen to participate without such consultation and accept all associated risks.
6. Emergency Medical Authorization & Financial Responsibility
I authorize Humble Haven Yoga and its representatives to secure or approve emergency medical care from licensed medical personnel as deemed necessary for my immediate health and safety. I understand that such care may include evaluation, transportation, first aid, or other services. I acknowledge that Humble Haven Yoga is not responsible for any medical expenses arising from illness, injury, or emergency care. I assume full financial responsibility for all such costs.
7. Release & Waiver of Liability
To the fullest extent permitted by law, I hereby release, waive, discharge, and covenant not to sue the Released Parties for any and all claims, injuries, damage, or losses arising out of or related to my participation in the Activities, whether occurring on the premises, offsite, or online. This waiver applies to ordinary negligence, including negligent rescue operations, but does not apply to gross negligence or intentional misconduct.
8. Indemnification
I agree to defend, indemnify, and hold harmless the Released Parties from any claims, demands, damages, liabilities, costs, or expenses (including attorney’s fees and court costs) arising out of or related to:
- My participation in the Activities
- My failure to follow instructions
- My violation of studio policies
- My actions that cause harm to myself or others
9. Damages, Costs, Attorney’s Fees & Negligent Rescue Operations
I agree that the Released Parties shall not be responsible for any damage, losses, attorney fees, court costs, or related expenses arising out of or related to my participation in any Activity, whether caused by the negligence of the Released Parties or otherwise, including any negligent rescue operations. I further agree to indemnify and hold harmless the Released Parties from any such damage, costs, or expenses.
10. Online, Offsite, and Remote Instruction
I understand and agree that this Agreement applies fully to Activities offered by Humble Haven Yoga, whether conducted:
- In‑studio
- Offsite
- Outdoors
- At third‑party venues
- During travel or retreats
- Via livestream, pre‑recorded video, or digital platforms
I voluntarily assume all risks associated with practicing yoga outside a controlled studio environment.
11. Participant Responsibility for Remote Practice
When participating remotely, I am solely responsible for:
- Choosing a safe practice space
- Ensuring adequate lighting, ventilation, and flooring
- Using props safely
- Monitoring my physical limits
12. Photo & Video Consent (Optional)
I grant permission for Humble Haven Yoga to use photographs or video taken during Activities for lawful promotional purposes unless I provide written notice opting out.
13. Mediation and Binding Arbitration
If a dispute arises, I agree to first attempt resolution through good‑faith mediation.
If mediation is unsuccessful, the dispute shall be resolved through binding arbitration.
I waive my right to a jury trial.
14. Governing Law, Venue & Severability
This Agreement shall be governed by the laws of the Commonwealth of Virginia.
The exclusive venue for any mediation, arbitration, suit, or proceeding shall be the Henrico County Circuit Court or another appropriate court within Henrico County, Virginia. If any portion of this Agreement is found unlawful or unenforceable, that portion shall be severed and stricken without affecting the validity of the remainder.
15. Attestation of Voluntary Agreement and Understanding
By signing this Release, I acknowledge that I have carefully read this four-page Agreement, fully understand its terms and legal consequences, and voluntarily agree to be bound by it without any inducement or coercion.
Student Code of Conduct
Students of Humble Haven Yoga are expected to comply with Humble Haven Yoga’s guidelines regarding class cancellations, late arrivals, payment policies, and terms and conditions that are accessible on the Humble Haven Yoga website. Students of Humble Haven Yoga are not permitted to harass anyone inside the premises as they are expected to treat all staff and fellow students with courtesy and respect. Harassment includes, but is not limited to:
Repeated hostile and unwanted words, behavior, or actions that are painful, hurtful, annoying, humiliating, or insulting
Unwanted sexual advances, such as inappropriate comments or requests
Unwarranted physical touch
Unwanted physical contact
Using insulting or offensive language
Threatening you or your property
Students are expected to refrain from disruptive behavior, including excessive talking or loud noises during class(es). Students are expected to respect personal space and property of other students, as well as the studio property and/or equipment. Students are asked to refrain from using cell phones during class. Students are expected to be welcoming of all individuals regardless of age, gender, race, ethnicity, sexual orientation, or ability. If management is notified of any of the above-referenced behaviors, Humble Haven Yoga reserves their right to prohibit this student from the premises for a period of time and/or indefinitely.
Humble Haven Yoga is a weapons-free workplace and prohibits the possession or use of dangerous weapons on company property. "Dangerous weapons" include firearms, explosives, knives, and other weapons that might be considered dangerous and/or that could cause harm. A license to carry a weapon does not supersede this company policy.
